Spirited Gamer respects the intellectual property rights of others and expects the same from our users and community. This policy outlines our procedures for responding to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA) and equivalent international copyright laws.
While the DMCA is a US law, we apply its principles globally as it represents a reasonable international standard for copyright dispute resolution.
REPORTING COPYRIGHT INFRINGEMENT
If you believe that content on spiritedgamer.com infringes your copyright, please send a written notice to our designated copyright agent containing all of the following:
- Your full legal name and contact information (address, phone number, email)
- A description of the copyrighted work you claim has been infringed
- The specific URL(s) on our site where the allegedly infringing material appears
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement made under penalty of perjury that the information in your notice is accurate, and that you are the copyright owner or authorized to act on their behalf
- Your electronic or physical signature
Send your DMCA notice to: legal@spiritedgamer.com with the subject line “DMCA Takedown Notice.”
We will respond to valid DMCA notices within 5–10 business days and remove or disable access to infringing content promptly.
COUNTER-NOTICE PROCEDURE
If you believe your content was removed in error — for example, because you have a license, or the use qualifies as fair use — you may submit a counter-notice containing:
- Your full legal name and contact information
- Identification of the content that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
- Your consent to the jurisdiction of the courts in your country, and that you will accept service of process from the person who filed the original notice
- Your electronic or physical signature
Send counter-notices to: legal@spiritedgamer.com with the subject line “DMCA Counter-Notice.”
If we receive a valid counter-notice, we may restore the removed content within 10–14 business days unless the original complainant files a court action.
REPEAT INFRINGERS
We maintain a policy of terminating the accounts of users who are found to be repeat infringers of intellectual property rights, in appropriate circumstances.
PROTECTING OUR CONTENT
All original content on spiritedgamer.com — including articles, graphics, videos, and branding — is protected by copyright. If you find our content being reproduced without permission, you may report it to us at legal@spiritedgamer.com and we will pursue appropriate action.
Permitted uses include sharing article links, quoting brief excerpts with attribution and a link back to the original, and sharing content for non-commercial commentary or criticism.
FALSE CLAIMS
Submitting a false DMCA notice or counter-notice may result in legal liability. Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that content is infringing may be liable for damages.
